better to try to establish it in each case, than to rest content with three or ten years residence. It is not necess- -ary to frame rigid rules by which the animus manendi is to be determined. If each case is considered judicially and with reference to previous cases, a set of conditions will be generally elaborated. It would be sufficient to begin with, to require proof of the continued residence of the applicant and of his legal wife in the Colony, and an established occupation in the Colony and perhaps the possession of property. As in the case of children it would be impossible to determine the animus manendi, no certifi- -cate should be issued to them, though parents should be allowed, if they so desire, to establish the birth of a child in the Colony, with a view to his receiving a certificate later. Children would be therefore excluded, and so would most young men, as they would find it almost impossible to prove that they intended to reside permanently in Hongkong.
19. Something more is necessary to prevent abuse of the certificate. Applicant should state the reason for his application, and no application should be entertained unless
the reason is a probable one, and is established to the
satisfaction of the Government. The certificate should not
be handed to applicant, but should be forwarded to the Consul at the port in China to which the holder proposed to
proceed. These two precautions will help to prevent the mis-
-use of a certificate. The holder of one will no longer be
enabled to leave the Colony and return to China, and there
make use of the certificate, perhaps, for years, without the knowledge of His Lajesty's Consuls or of the Hongkong Govern-
-ment.
20. The certificate should state on the face of it the protection to be afforded, and on issuing it, the Goverment should warn the holder that he must not expect to receive
more. The wording might be:-
